RENTAL AGREEMENT
RENTAL AGREEMENT
This Rental Agreement (the “Agreement”) is made by and between Benoît de MONTLEBERT « Le Relais du Château" (“Homeowner”) and (“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1.Property.
The property is located at: Le BOSQ. TORTEVAL-QUESNAY 14250 AURSEULLES
2. Rental Party.
Indicate the names of Each Person in your Party (please give age if under 18)
3. Maximum Occupancy.
The maximum number of guests is limited to 2/4/8 persons. Maximum number of overnight occupants at all the property cannot be exceeded: 14.
4. Term of the Lease.
The lease begins at: (the “Check-in Date”) and ends at: (the “Checkout Date”).
5. Minimum Stay.
This property requires a week minimum stay.
6. Rental Rules.
Guest agrees to abide by the Rental Rules attached as Exhibit A (scroll down) at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
7. Access.
Guest shall allow Homeowner or Homeowner’s Agent access to the property for purposes of at any time to investigate disturbances, check occupancy, check damages, and make repairs, alterations and improvements.
8. Rental Rate and Fees.
a. Rental Rate.
An initial payment of is required to confirm reservation. The remaining balance owing, including the security deposit, is due 45 days before the Check-in Date.
b. Security Deposit.
A refundable security deposit of 500€ is required. The deposit is for security and shall be refunded within 30 days of the Checkout Date provided no deductions are made due to:
i. damage to the property or furnishings;
ii. dirt or other mess requiring excessive cleaning; or
iii. any other cost incurred by Homeowner due to Guest’s stay.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
No refunds or fee adjustments will be made due to a defect in the Property’s condition unless Guest makes Homeowner aware of the problem immediately upon discovery and the Homeowner, or their designated Representative(s) are unable to remediate the matter within a reasonable amount of time (hours of business, etc.)
9. Cancellation Policy.
Notice of cancellation has to be received in writing 90 days or more before arrival date. Guest that wishes to cancel his/her reservation, payment(s) previously made will be refunded as follows
-50% if cancelled more than 90 days prior to the Check-in Date
-25% if canceled betwee 25% between 90 and 30 days prior to the Check-in Date
-Failure to pay the final balance due 60 days before arrival will be deemed a cancellation with no refund due. Security deposit is fully refundable.

We encourage all renters to purchase traveler insurance. Below are some references you may contact to purchase such insurance:
11. Hold Harmless Agreement.
Guest acknowledges and understands that they are responsible for each and every guest or guardian during your rental dates of …………and is solely responsible for any property damage, accident, injury or loss sustained to any person while in residence. Homeowner accepts no legal or financial responsibility. Guests and guardians assume all risk of injury or other loss resulting from a recreational activity and will hold Homeowner harmless hereto. Guest hereby agrees to indemnify and hold Homeowner, agents, employees, and officers harmless from any claim, including those of third parties, arising out of or in any way a result of the guests use of the premises or items therein. Homeowner cannot be held responsible for : the failing of any other company due to said company’s error or service interruption (i.e. electricity, water, gas, cable, wireless provider, etc.) and acts of neighbors such as: construction, road repair and maintenance or act of god (weather). However, Homeowner agrees to do all that is humanly possible to remedy any issue as quickly as possible.
NO REFUNDS OR ADJUSTMENTS OF RENTAL FEES WILL BE MADE FOR ANY OF THE ABOVE CONDITIONS.
12. Attorneys’ Fees/Costs - Venue.
In the event an arbitration, suit or action is brought by any party under this Agreement to enforce any of its terms, or in any appeal therefrom, it is agreed that jurisdiction and venue shall be in King County, Washington, and that the prevailing party shall be entitled to all costs, including reasonable attorney fees, to be fixed by the arbitrator, trial court, and/or appellate court. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.

RENTAL RULES
1. Smoking is NOT ALLOWED INSIDE. Smoking is only allowed outside.
2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
3. Keep the property and all furnishings in good order
4. Only use appliances for their intended uses
5. Pets are NOT allowed.
6. Housekeeping: There is no daily housekeeping service. Linens and bath towels are included in the house. If you stay more than a week, house cleaning will be provided on a weekly basis. If more maid service is needed, it can be arranged for a fee.
7. The fireplace in the main living room can be used if needed. All the other fireplaces in the house are not operational and must not be used.
8. The property is on a well and septic systems. The septic system is very effective; however, it will clog up if improper material is flushed.
9. Some guidelines to understand for our family house: hot water tanks are for reasonable short showers per day particularly when the house is in full capacity. Water heating is twice a day between 1pm and 3pm and between 1am and 6am.
10. Maximum temperature in the house is 19- 23 degrees Celsius (depending on the time of the year) and consequently doesn’t require AC.
11. Since you are living in the countryside, you might see some harmless insects occasionally “visiting” the house or flying through the windows as they are not equipped with screens.
12. The tennis court is shared with two other family properties. The use of the court will be more specifically explained on the day of your arrival.
